1. Definitions

Buyer: A natural or legal person who acquires products through our digital channels, including the website www.flowinspiresus.com, WhatsApp, Instagram, or other channels.

Product: The clothing, footwear, and accessories items offered for sale through the website.

Flow: Flow Inspires Us, a company based in Florida, United States, and its authorized representatives.

Services: The online shopping platform, customer service, delivery, exchanges, returns, and post-sale service offered by Flow.

Contract: The agreement formed between the Buyer and Flow when the Buyer completes a purchase through our digital channels.

2. Scope and Application

These Terms and Conditions constitute the complete agreement between Flow and the Buyer regarding the purchase of products and replace any previous agreement. They apply to all purchases made through our digital channels, including www.flowinspiresus.com.

Flow operates from Florida, United States, and makes international shipments from Colombia. By making a purchase, you accept these conditions in their entirety and commit to complying with them.

3. Prices and Currency

Currency: All prices are expressed in United States dollars (USD). Prices shown include the cost of the product but do not include taxes, duties, customs fees, or import charges that may be generated.

Price variation: Prices may vary according to specific promotions or sales channels. Flow reserves the right to modify prices at any time. However, changes will not affect orders already confirmed and paid.

International taxes and duties: Taxes, customs duties, import fees, customs processing charges, and other levies that may be generated in the destination country will be assumed by the Buyer. Flow is not responsible for these costs, which are determined by the customs authorities of each country.

Availability: Prices are subject to inventory availability. If a product is not available at the time of processing your purchase, we will notify you and offer alternatives.

4. Purchase Process

When making a purchase, you must provide accurate contact information, shipping address, and payment method. Flow will send a purchase confirmation to the provided email address. The purchase is considered accepted when Flow sends the payment approval confirmation.

Flow reserves the right to reject or cancel any purchase it considers suspicious, fraudulent, or in violation of these Terms.

5. Payment Methods

Flow accepts credit cards, debit cards, bank transfers, and other payment methods available on the website. Payment must be completed before the order is processed and shipped.

All payment data is processed securely. Flow does not store complete card numbers. In case of payment problems, Flow will contact you to resolve the situation.

6. Shipping and Delivery

Delivery times: Orders will be shipped to the address provided by the Buyer at the time of purchase. The estimated delivery time is seven (7) to ten (10) business days from payment confirmation. This time is estimated and may vary depending on the destination, customs processes, customs inspections, weather conditions, or external factors beyond Flow's control.

Delivery responsibility: Flow ships from Colombia. Any person at the registered address is understood to be authorized by you to receive the package. Flow is not responsible for deliveries made to the provided address, regardless of who receives the package.

Shipping costs: International shipping costs are included in the total shown during checkout or must be quoted before processing your purchase.

Tracking: Once dispatched, you will receive a tracking number to track your package in real time.

If you don't receive your order: If not received, the order will be returned to the distribution center. The customer must assume reshipment costs if requesting the package be sent again. If reshipment is not requested within five (5) calendar days after the estimated delivery date, Flow may cancel the purchase, returning the amount paid minus logistics costs incurred.

7. Product Exchanges

Timeframe: Exchange requests must be made within thirty (30) calendar days following the delivery date.

Conditions: The product must be unused, in perfect condition, with all original tags and in original packaging. For clothing and footwear, this means it has not been tried on, used, or washed.

Exchange options: The exchange is subject to availability and can only be made for a product of equal or greater value. If the new product costs more, you pay the difference.

Procedure: Contact Flow via WhatsApp at +57 310 2485375 or email hola@zonaehome.com indicating your order number and desired product. Once approved, Flow will instruct you on how to proceed with shipping the original product.

Costs: Shipping costs for exchanges will be assumed by the Buyer. If the exchange is due to confirmed manufacturing defect, Flow may assume pickup costs.

Customized products: Customized or made-to-order products cannot be exchanged. These must be paid in full before production begins.

8. Warranty

Flow offers legal warranty on all its products in accordance with applicable legislation. To apply for warranty, the product must retain its original condition and not have been modified, altered, or used. Proof of purchase (email confirmation or order number) is required.

The warranty covers manufacturing defects. It does not cover damage from normal use, wear and tear, incorrect washing, accidental damage, or modifications made by the customer.

9. Warranty Returns

If the product has a manufacturing defect, you must report it within forty-eight (48) hours of receipt by contacting Flow via WhatsApp at +57 310 2485375 or email hola@zonaehome.com. Provide clear photographs of the defect.

The case will be evaluated in accordance with applicable legislation. If approved, Flow will cover the cost of picking up the defective product.

If return does not meet warranty conditions: If the alleged defect is not confirmed as a manufacturing defect, the product will be returned to the customer, who must assume shipping costs.

10. Money Refunds

Money refunds are subject to internal evaluation by Flow. To request a refund, contact hola@zonaehome.com or +57 310 2485375 on WhatsApp.

If approved, you must provide banking information for electronic transfer and a formal request. The refund will be made via bank transfer within thirty (30) business days following approval and receipt of the product at our facilities.

No money refund is made for: Customized products. Products on promotion or discount. Used, washed, or altered products.

11. Right of Withdrawal (According to Local Legislation)

The right of withdrawal for purchases made online through www.flowinspiresus.com depends on the local legislation of the Buyer's country of residence. Flow respects the consumer protection laws of each country.

Examples of legislation by country:

Colombia: If you are a resident of Colombia, you have the right to exercise withdrawal within five (5) business days following delivery, in accordance with Law 1480 of 2011.

European Union: If you are a resident of an EU country, you have a fourteen (14) calendar day withdrawal right in accordance with Directive 2011/83/EU.

Other countries: If you are a resident of another country, Flow respects the applicable local consumer protection legislation. Check the laws of your country before making a purchase.

United States: Flow operates from Florida, where there is no mandatory federal right of withdrawal. However, some states have specific legislation. Check your state.

General conditions (when applicable): The product must be returned in exactly the same condition as received: unused, unwashed, with all original tags and labels intact. For clothing and footwear, it has not been tried on or used.

How to exercise: If you have the right to withdrawal according to your local legislation, contact Flow via WhatsApp at +57 310 2485375 or email hola@zonaehome.com stating your intention within the applicable legal timeframe.

Shipping cost: Return shipping costs will be assumed by the Buyer, unless local legislation specifies otherwise.

Exceptions: Right of withdrawal does not apply to personal use items such as jewelry, costume jewelry, or fragrances, nor to customized products, in accordance with most international legislation.

12. Product Type Specifications

Apparel: Clothing cannot be exchanged or returned if it has been washed, tried on, or used. There must be no usage creases, stains, or odors. Tags must be completely intact.

Footwear: Must not have been worn. Must have no marks on the sole, dust, wear, or stains. Must be in exactly the same condition as received, including the original box.

Accessories: Must not have usage marks, creases, deformations, stains, or damage. Must be in perfect condition.

Costume jewelry and jewelry: Cannot be exchanged or returned once opened for hygiene reasons.

13. Claims Classification

Claims are classified as:

Technical or quality claims: Faulty stitching, torn fabric, broken zippers, undisclosed color fading.

Logistics claims: Missing product, incorrect product, damaged package.

Commercial claims: Billing errors or commercial condition errors.

14. Responsibilities

Flow's responsibility: Ensure products are delivered in good condition. Coordination with carriers. Quick response to claims.

Buyer's responsibility: Provide complete and correct address. Be available to receive the package. Inspect upon delivery. Report damage within 48 hours. Maintain the product in proper condition.

Force majeure cases: Flow is not responsible for delays caused by force majeure events (extreme weather conditions, roadblocks, natural disasters, pandemics, carrier strikes, unforeseen customs processes).

Customs: Flow is not responsible for delays, rejections, or losses caused by customs procedures. The Buyer is responsible for complying with import regulations of their country.

15. Data Protection

Flow protects your personal information in accordance with the Privacy Policy. Your information will be handled in compliance with applicable data protection laws.

16. Limitation of Liability

Flow is not responsible for indirect, incidental, special, or consequential damages arising from the use of Services or products. Flow's total liability is limited to the amount paid for the product.

17. Changes to Terms

Flow reserves the right to modify these Terms at any time. Changes will be published on www.flowinspiresus.com. Continued use of the platform constitutes acceptance of the modified terms.

19. Applicable Law and Dispute Resolution

Applicable law: These Terms are primarily governed by the laws of the State of Florida, United States. However, Flow respects the consumer protection laws of your country of residence when they are more favorable to you.

Application by country: For Buyers residing in Colombia, the provisions of Law 1480 of 2011 regarding consumer protection also apply. For Buyers residing in the European Union, Directive 2011/83/EU regarding consumer rights in distance selling is respected. For Buyers in other countries, applicable local consumer protection legislation is respected as appropriate.

Dispute resolution: In case of dispute or disagreement with Flow:

Step 1 - Direct communication: The Buyer must first contact Flow at hola@zonaehome.com or +57 310 2485375 on WhatsApp to attempt to resolve the situation amicably.

Step 2 - Mediation: If direct communication does not resolve the conflict, Flow offers international mediation online through a neutral third party to reach a mutual agreement.

Step 3 - Arbitration: If mediation fails, any dispute shall be submitted to binding arbitration in accordance with the UNCITRAL Arbitration Rules, in English language, through online proceedings. The place of arbitration shall be Miami, Florida.

Local authorities: The Buyer has the right to file complaints with consumer protection authorities in their country: Superintendence of Industry and Commerce (SIC) in Colombia, Consumer Protection Authorities in the EU, or equivalent authorities in other countries.

Courts as a last resort: Only if arbitration is not viable or has failed may the parties resort to the courts of the State of Florida, United States, as a forum of last resort.

20. General Provisions

Severability: If any provision of these Terms is declared invalid, the remaining provisions will remain in effect.

Waiver: Failure to exercise any right granted by these Terms does not constitute a waiver of that right.

Language: These Terms are available in Spanish and English for your convenience. For legal purposes and in arbitration proceedings, English shall be the official language. In case of discrepancy between versions, the English version shall prevail for arbitration purposes, although Flow commits to clarifying any ambiguity in both languages.
